8.1) – The tenants agree to share the use of the front and back garden areas with the occupants of the apartment above this property. The Tenants agree to share the maintenance responsibilities for the front and back gardens and ensure that they are kept in good seasonal order throughout the tenancy. The tenants agree that the shed is not used by them and is unavailable., 8.2) – The gutter grate in the back yard is small and can clog up with debris from the pipes. The tenants agree to maintain that the grate is kept free of debris at all times, to ensure that it does not cause a blockage, which can cause flooding in the shared passageway with the property next door., 8.3) – The tenants agree to walk the pet off away from the property on a daily basis and to clean up any dog mess from the garden immediately. The garden is a shared space and the tenants understand and accept their responsibly to ensure their pet does not cause a nuisance to any other tenants., 8.4) – It is hereby agreed between the Landlord and Tenants that the Landlord’s permission is granted to allow a specific pet to be kept on the Property, namely a well-behaved small quiet house-trained Boston Terrier dog (‘the Pet’). The Tenants hereby undertake and agree to remedy and pay for any and all damage caused to the Property and/or contents of the Property that has been caused by the Pet residing in the property. In particular, if, at the conclusion of the Tenancy, the walls, skirting boards, carpets and/or floor coverings cannot be returned in the condition in which the Tenants first received the property, they shall be fully repaired or replaced at the Tenants’ full expense with no allowance for “fair wear and tear”. Legally tenants are entitled to make fair wear and tear to a property, however the tenants are giving up this right for any wear and tear or damage caused to the property or its contents due to the presence of their pet in order to be allowed to keep the Pet within the property; this is because having a pet in the property may vastly increase the amount of wear and tear. The Tenants agree to pay for the full professional end of tenancy cleaning of the property (including carpets and soft furnishings) at the end of the Tenancy, or during the tenancy should the Landlord or the Landlords’ Agent deems it necessary, to remove all traces that the Pet was ever at the property, including, but not limited to, treating the property for fleas and mites (if deemed required by the inventory clerk or another suitable expert such as a pest controller). The professional cleaning must remove all traces of the presence of the Pet, and must be carried out by an approved contractor who is a member of or one which the Landlords Agent can recommend. Proof of this cleaning must be provided (via a copy of the receipt) and the inventory clerk must agree that the property was returned as in a “Professionally Cleaned” condition with all traces of the presence of the Pet removed at the check-out appointment. If cleaning or repairs are not carried out to this standard before the start of the checkout appointment, or within 5 working days of being requested, if requested during the Tenancy by the Landlord or the Landlords’ Agent, the Tenants agree that the Landlord or their Agents may hire suitable professionals to carry out this work at a reasonable cost to be charged to the Tenants and deducted from the Tenancy Deposit without dispute.
